1. Acceptance of Terms
By accessing and using FooFoo.AI's services, you agree to be bound by these Terms of Service and our Refund Policy, which is incorporated by reference.
2. Usage License
When you purchase or lawfully obtain generated content from our platform, you receive a non-exclusive, worldwide license to use that content as described at the time of purchase or in the applicable product terms (for example, commercial use where offered).
3. Restrictions
You may not:
- Use generated content for illegal purposes or in violation of third-party rights
- Redistribute or resell content in ways that exceed your license
- Misrepresent AI-generated content as human-created where that would deceive others in a prohibited way under applicable law
- Attempt to reverse engineer, overload, or abuse our systems or third-party AI providers
4. Service Modifications
We reserve the right to modify, suspend, or discontinue any aspect of our service at any time. We will use reasonable efforts to give notice of material changes where practicable.
5. Fees, billing, and credits
- Prices are shown at checkout in the currency and payment method we support.
- Credits are digital balances used to access features. Unused credits do not expire unless we state otherwise at purchase or in these Terms.
- Taxes may apply based on your location; you are responsible for any taxes we are required to collect.
- Payment processing is handled by third parties (for example Stripe). Their terms govern how they handle your payment data.

6. Limitation of liability
To the maximum extent permitted by applicable law:
- FooFoo.AI is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the service.
- Our total liability for any claim arising out of these Terms or the service is limited to the greater of (a) the amount you paid us for the service in the twelve (12) months before the claim, or (b) fifty U.S. dollars (USD $50) if you have not paid us, except where such a cap is not allowed by law.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.
7. Indemnity
You agree to defend and indemnify FooFoo.AI and its operators from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the service, your content, or your violation of these Terms, to the extent permitted by law.
8. Governing law
These Terms are governed by the laws applicable to FooFoo.AI's operating entity and your jurisdiction as required by mandatory consumer protection rules where you live, without regard to conflict-of-law rules that would apply another jurisdiction's laws.
